Official Analysis

The Election Code of Conduct issued by the Election Commission clearly prohibits distribution of cash and goods to influence voters, without mentioning any minimum threshold. The rules state that parties and candidates shall not distribute cash, commodities, feasts or alcohol to voters during the campaign period. There is no exemption for small amounts or gift hampers.

Some local campaigners have attempted to misinterpret welfare activities or festival greetings as a legal space for gifts, but the code and past enforcement show that such acts can be treated as vote-buying.
